Phillips Law represents consumers who have been sued by debt buyers.  Debt buyers are those entities which buy old debts, typically credit card debts, and attempt to collect from consumers on these accounts.  These accounts are traded often and, frequently, the debt buyers do not have the proper paperwork or information to file a lawsuit against a consumer, yet they do anyway. 

If you have been sued by a collection agency and any of the following apply to you, you may have a defense to the collector's claims:

• You have not paid on the account for at least 3 years;
• The account is not your account; or
• The debt the collector is attempting to collect is included in an active Chapter 13 bankruptcy or the debt was previously discharged in a bankruptcy case.
